Buckhead Transportation LLC Shipping Agreement
This agreement is entered into by Buckhead Transportation LLC, hereafter referred to as “Buckhead Transportation,” and the vehicle owner or authorized representative, collectively and individually referred to as the “Client,” for the purpose of transporting a motor vehicle from the designated pickup location to the agreed-upon destination. Both parties agree to the following terms and conditions:
1. Transport Schedule
Buckhead Transportation will make every reasonable effort to adhere to the agreed-upon pickup and delivery schedules. However, delays may occur due to factors beyond our control, including but not limited to carrier availability, mechanical issues, inclement weather, or other unforeseen circumstances. Buckhead Transportation shall not be held liable for any charges or liabilities arising from such delays, including but not limited to costs associated with airline tickets or rental car fees. The carrier’s schedule will be provided to the Client at the time of dispatch. By accepting these terms, the Client releases Buckhead Transportation from any liability and waives the right to pursue legal action against Buckhead Transportation, its employees, officers, volunteers, and agents.
2. Exclusive Contract
The Client agrees not to engage any other broker or carrier for vehicle transport during the agreed-upon shipping period. If the Client is found to be working with another broker or carrier during this time, they will forfeit their non-refundable deposit fee.
3. Door-to-Door Transport
Contracted carriers provide door-to-door transport whenever possible. If the truck driver cannot physically access the pickup or delivery address due to narrow streets, low-hanging trees, or tight turns, the driver may request that the Client meet them at a nearby accessible location.
4. Personal Items
Carriers are not licensed or insured to transport personal or household goods. Buckhead Transportation understands that the Client may need to place items in the vehicle; however, carriers are not liable for any damage caused by the excessive or improper loading of personal items. All personal belongings must be stored in the vehicle’s trunk and should not exceed a limit of 100 lbs. Exceptions to this limit must be pre-approved by Buckhead Transportation and may incur additional fees. Misrepresentation of personal belongings may result in a price adjustment or a dry run fee of $150 if the shipment differs from the initial agreement. A rescheduling fee of $75 will apply if the vehicle is not ready as indicated by the Client when the carrier is dispatched. The Client must inform Buckhead Transportation if they are unavailable for pickup or delivery, and an alternate representative must be provided.
5. Vehicle Condition
The vehicle must be presented to the carrier in good running condition with no more than a half tank of fuel. The carrier is not responsible for damage caused by leaking fluids, freezing, unsecured exhaust systems, or antennas. Any claims for loss or damage must be noted and signed on the condition report at the time of delivery.
6. Insurance Coverage
Carriers provide insurance coverage for claims arising from damage incurred during transport, with cargo insurance ranging from $100,000 to $250,000 per load, in addition to a minimum of $750,000 in public liability and property damage coverage. Any damage occurring during transport is the carrier's responsibility. Buckhead Transportation will assist the Client in initiating an insurance claim by providing the necessary documentation. All claims must be documented and signed at the time of delivery and submitted in writing within 15 days.
7. Rescheduling and Cancellation
A rescheduling fee of $75 will apply if the vehicle is not ready as indicated by the Client when the carrier is dispatched. If the Client is unavailable for pickup or delivery, an alternate representative must be designated. Should the vehicle become unavailable during the scheduled pickup window after an order has been placed, Buckhead Transportation will not refund the deposit amount. Cancellations of dispatched orders must be made by contacting Buckhead Transportation by sending an email to buckheadtransportationllc@gmail.com Cancellations must be submitted no less than 24 hours before the scheduled pickup date and are subject to a non-refundable cancellation fee of $20.
8. Price Adjustments
While Buckhead Transportation strives to dispatch vehicles according to the Client’s requested schedule and the original quoted price, external factors such as fuel price fluctuations, driver shortages, inclement weather, and inflation may necessitate a revised price quote. The Client must agree to the updated quote; if not, cancellation charges will apply. By accepting these terms, the Client waives any right to request a refund upon cancellation.
9. Non-Operational Vehicles
An additional fee of $150 will be charged for all non-operational vehicles. This fee will be included in the final quote provided by Buckhead Transportation. If a vehicle becomes non-operational during transport, this fee will be applied to the original quote.
10. Prompt Transport
Buckhead Transportation agrees to promptly secure a carrier to transport the Client’s vehicle according to the Client's instructions. However, specific pickup or delivery dates cannot be guaranteed. All deposits made are final and non-refundable. A cancellation fee of $20 will be charged for orders canceled within seven days of the requested pickup date. Buckhead Transportation is not responsible for vehicle rentals or mechanical failures during transport. The Client agrees to pay the quoted price for delivered vehicles and agrees not to initiate a chargeback on any payment made via credit card.
11. Legal Jurisdiction
This agreement is governed by and construed in accordance with the laws of the State of New York. Any legal action arising from this agreement must be filed in a court with jurisdiction over the matter, with Buckhead Transportation’s liability limited to the broker’s fee. The Client consents to the jurisdiction of such courts and waives any right to jurisdiction in any other location.
12. Payment
The Client authorizes a down payment to be made to Buckhead Transportation via CashApp, Zelle, Venmo, credit card, PayPal, or check by phone or mail. The remaining balance is due upon delivery and must be paid in full via cash, cashier’s check, or money order to the authorized transporter.
Client Agreement
By signing below, I, the Client, hereby acknowledge that I have read, understood, and agree to the terms and conditions set forth in this agreement.
